(erielack) Re: Personal Rights, Revisited

I do NOT agree with Paul that " it was decided that it was not appropriate
subject matter for this forum." If it was so decided, whoever it was that
decided it may have been in error. ANYONE who goes out railfanning (and
specifically on the one-time EL -- which is what we are talking about) should be
aware of some of the problems, stupidities, etc., encountered when dealing with
law enforcement and rail operators in today's security-minded world. If this is
"not appropriate subject matter for this forum," that what is?

As an aside, I agree, always be polite and do NOT argue with any law
enforcement officer when challenged -- but be sure to ask him/her to state exactly
what statute is it you are in violation of, the officer's name, badge, vehicle
number, etc. Often, when asked specifically what statute you are in
violation of, the officer will start with the "hem, haw, er, ah" routine.

Why is officer unable to site statute? Because such a statute does not
exist! If you are to be charged with a crime, you must be advised what the crime
is and what law/statute you violated. As no such a thing exists, the
exasperated officer will most likely warn you to be more cautious about what you are
doing and warn you not to trespass on private property (personal experience
here).
